Under California Penal Code section 1203.3, the court has authority to terminate probation at any time during the probationary period.
In practice, most judges will require a person to complete at least half of the probationary period before they will seriously consider the motion. They will also want to ensure that a person has successfully completed all terms of probation such as fines, classes, public work serve and restitution and that circumstances exist to justify early termination.
